Terms of Service — CallBirdAI
Effective Date: October 5, 2025
1. Acceptance of Terms
These Terms govern your use of CallBird AI, provided by Rocket Solutions LLC (“Rocket Solutions,” “we,” “us”). By using CallBird AI or related services, you agree to these Terms.
2. Services Provided
CallBird AI provides:
AI-powered call answering and automated appointment scheduling
Call transcription and summary delivery via an app
Emergency call transfer to designated owner phone numbers
Service features and pricing are described on the website and in invoices.
3. Eligibility
You must be 18+ and authorized to bind your business. You must provide accurate information and secure login credentials.
4. Customer Responsibilities
Provide accurate call routing and owner contact info
Comply with all applicable laws, including HIPAA if handling PHI
Execute a Business Associate Agreement (BAA) before routing PHI to CallBird AI
Obtain required consent for call recording under applicable jurisdictions
5. HIPAA & PHI
CallBird AI signs BAAs with covered entities
Once BAA is in place, Rocket Solutions implements required HIPAA safeguards
Covered entities remain responsible for compliance in their use of CallBird AI
6. Billing and Payment
Fees are set on the website or in contracts
Payments are net 30 unless otherwise agreed
Subscription cancellations and refunds follow the published policy
7. Data Ownership & License
Customer owns all call content
By using CallBird AI, you grant Rocket Solutions a license to store, process, and reproduce content to provide services, improve models (de-identified), and comply with law
8. Confidentiality
Nonpublic business information of both parties must be kept confidential
Customer data is confidential and only disclosed as permitted or required by law
9. Third-Party Services
CallBird AI may use subprocessors for hosting, analytics, and communication
A current list of subprocessors is maintained and disclosed as required
10. Disclaimers and Liability
Services are provided “as is”
Rocket Solutions is not liable for indirect, special, incidental, or consequential damages
Aggregate liability is capped at amounts paid by customer in the prior 12 months
Does not limit liability for death, personal injury from gross negligence, or statutory liabilities
11. Indemnification
Customer indemnifies Rocket Solutions against claims arising from:
Misuse of CallBird AI
Improper handling of PHI or personal data
Violation of law
12. Termination
Rocket Solutions may suspend or terminate access for violations or abuse
Termination does not relieve customer of unpaid fees
13. Export and Legal Compliance
Customers must comply with all applicable export laws
Customer is responsible for obtaining consent for call recording and AI processing
14. Governing Law
These Terms are governed by Georgia law unless otherwise specified in the contract.
15. Changes to Terms
Rocket Solutions may update Terms; material changes will be communicated to account owners and posted
